Terms of Service

Last updated

These terms are the agreement between you and ZUBA PROPTECH LIMITED (“Zuba”, “we”, “us”) when you use zuba.ng. By creating an account, browsing listings or otherwise using Zuba, you agree to them. If you do not agree, please do not use Zuba.

The short version

  • Zuba connects people looking for property with agents. We are not a party to any rent, lease or sale.
  • Agents are responsible for their listings being accurate and lawful.
  • A verified badge tells you what Zuba has checked. It is not a guarantee.
  • Always inspect a property and check its documents before you pay anything.
  • Zuba is free to use today. We will tell you before we charge for anything.

01 What Zuba is

Zuba is an online marketplace for property in Nigeria. It includes:

  • listings of homes, land and commercial property to rent, lease or buy;
  • profiles of agents and the verification of their professional credentials;
  • the Tenant Registry, where verified agents record and check tenant history;
  • tools for agents, such as a dashboard, enquiry tracking and receipts.

Zuba is a technology provider, not an agent, broker or landlord. We do not own, manage or guarantee any property on Zuba, and we are not a party to any agreement between you and another user.

02 Your account

  • You must be at least 18 and able to enter a binding contract under Nigerian law.
  • The information you give us must be accurate, and you must keep it up to date.
  • One person, one account. Do not create an account for someone else or pretend to be someone you are not.
  • Keep your password private. You are responsible for what happens under your account. If you think someone else has got in, tell us straight away at support@zuba.ng.

03 Agent verification

Agents are verified in tiers. To reach the first tier, an agent gives us their name, phone number, the state they work in and their professional association membership number, and can start listing right away. Higher tiers require documents, such as a government ID, CAC registration and a selfie, which our team reviews before the tier is granted.

A verified badge shows which checks an agent has passed at the time they passed them. It is not a guarantee or endorsement of the agent’s conduct, their listings or the outcome of any deal.

If an agent gives us false, expired or fraudulent details, we will suspend or close their account, and we may report them to their association or the authorities.

04 Listings

If you list a property on Zuba, you confirm that:

  • you have the right to market it, from the owner or the owner’s authorised representative;
  • the price, location, photos, availability and description are accurate, and you will update or remove the listing when they change;
  • the listing is not a duplicate, a bait listing for a property that is not available, or a property you know to be in a title dispute.

You keep ownership of the photos and text you upload. You give Zuba permission to store, display, resize and share them as needed to run and promote the marketplace, for as long as the listing is on Zuba.

We may edit the formatting of a listing, or remove it without notice, if we believe it breaks these terms, the law, or is likely to mislead.

05 The Tenant Registry

The Tenant Registry is for lawful tenant screening only. If you file or search a report, you agree:

  • to file only what is true and that you can support, such as receipts, messages or photos;
  • not to file reports to pressure, punish or embarrass anyone;
  • not to copy, share or publish what you find in the registry outside the tenancy decision you are making.

Zuba does not check every report before it appears, and does not guarantee that a report is accurate. Anyone named in a report can ask us to review it, as explained in our Privacy Policy. We will remove reports that turn out to be false, and we may close the account of anyone who files them.

06 Fees

Zuba is currently free for property seekers and agents, including agent verification. If we introduce paid features, we will publish the price and tell you before you are charged, and nothing that is free today will start costing you money without your agreement.

Zuba never asks you to pay a deposit, inspection fee or rent through Zuba. Any payment for a property is between you and the agent or owner.

07 What you must not do

  • Use Zuba for anything unlawful, including fraud or collecting money for a property you cannot let or sell.
  • Pretend to be another person, agent or agency.
  • Scrape, copy or harvest listings, profiles or registry data with automated tools without our written permission.
  • Contact users for anything other than the property they listed or enquired about.
  • Interfere with how Zuba works, test its security without permission, or upload anything harmful.

08 Messages from Zuba and other users

We send emails about your account, such as email confirmation, password resets and verification updates. These are part of the service. Newsletters are optional and every one has an unsubscribe link.

When you message an agent by phone or WhatsApp, that conversation happens outside Zuba, under the other service’s own terms. We cannot see or control it.

09 Who owns what

Zuba’s name, logo, design and software belong to us or the people we license them from. Apart from the content you upload, you may not copy or reuse them without our permission.

10 Check before you pay

Information on Zuba comes from agents and other users. We work to keep fake listings and agents off Zuba, but we cannot promise every listing is accurate or available.

Before you pay anything:

  • inspect the property in person;
  • ask to see the title documents (for example the Certificate of Occupancy or Governor’s Consent) and check them, ideally with a lawyer or surveyor;
  • confirm that the person you are paying has the right to collect the money.

Zuba is provided “as is”. To the extent Nigerian law allows, we give no promise that it will always be available, error-free or fit for a particular purpose.

11 Limits on our liability

To the extent Nigerian law allows, Zuba is not liable for indirect or consequential losses, or for losses caused by a deal between users, an inaccurate listing or a Tenant Registry report filed by someone else.

Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud or for death or injury caused by our negligence.

12 Closing or suspending an account

You can close your account at any time by emailing support@zuba.ng.

We may suspend or close an account, or remove content, if it breaks these terms, if we suspect fraud, or if the law requires it. Where it is safe and lawful to do so, we will tell you why.

13 Changes to these terms

We may update these terms as Zuba grows. We will change the date at the top of the page and, for important changes, tell you by email or on Zuba before they take effect. If you keep using Zuba after that, the new terms apply.

14 Governing law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria, and Nigerian courts have jurisdiction over any dispute about them. If you have a complaint, please write to support@zuba.ng first. Most problems can be sorted out quickly that way.
